Bad news for debtors. 

A recent ruling by Judge Cassling in Chicago, clarifies provisions of the automatic stay in regards to returns of vehicles that were taken pre-bankruptcy filing.

In this case, the city of Chicago seized the debtor’s vehicle prior to her filing a chapter 13 bankruptcy case.   She sought to have the court order the creditor to return the vehicle because of her chapter 13 bankruptcy case. 

Judge Cassling ruled that the exception to the automatic stay carved out by 11 U.S.C. § 362(b)(3), which reads  “does not operate as a stay—under subsection (a) of this section, of any act to perfect, or to maintain or continue the perfection of, an interest in property to the extent that the trustee’s rights and powers are subject to such perfection under section 546(b) of this title….”

Therefore, since the city has a possessory lien on the vehicle which was perfected when they seized the vehicle, they are allowed to retain that lien and not be in violation of the automatic stay. 

This differs from case law that requires a secured creditor, such as a car finance company, since their lien was not statutory, merely consensual (thru contract recorded against the title) to give back a vehicle upon filing of the chapter 13 bankruptcy.

Chapter 13 Bankruptcy Debtors who had mortgage loans with Wells Fargo may be getting some compensation for violations that occurred from 2011 to 2015.

(Reuters) – Wells Fargo & Co will pay $81.6 million to homeowners for denying them a chance to challenge mortgage payment increases imposed during their bankruptcy proceedings, the U.S. Justice Department said on Thursday.
Wells violated a 2011 U.S. bankruptcy law by failing to send a type of legal notice about homeowners’ mortgage payment increases to bankruptcy courts. The law requires the notice to include disclosures to ensure that fees and charges by banks to homeowners in bankruptcy proceedings are accurate, the Justice Department said.  Read more at:

How to Know When Bankruptcy Is Right for You 
Before you decide to file for personal bankruptcy you should be aware that it is not necessarily the best choice for everyone. For many people, bankruptcy should be the last-case scenario only after they have weighed all of their options and determined that they can’t remedy their financial woes.
Ultimately, the decision to file for bankruptcy should be made between you and an experienced bankruptcy attorney. However, there are other methods of determining whether you can get the help you need before consulting with a lawyer and we will outline some of them here.
Are You Eligible for a Debt Management Plan? 
Most people who are financially distressed look to bankruptcy to alleviate them from credit card debt and help them get a new start. Before signing the bankruptcy paperwork, sometimes a debt management plancan help you to reduce your monthly payments, lower interest rates, stop late fees and collection calls and ultimately put you on a path to avoiding bankruptcy.
If you have not already, see if you are eligible for a debt management plan before deciding it’s time to throw in your chips.
Determine if Bankruptcy will Actually Help You
In some cases, bankruptcy will not actually alleviate you of all your debts. Certain types of unavoidable debts, called priority obligations, may not be wiped out in bankruptcy.
You have to consider what you are trying to accomplish by filing for bankruptcy and find out if Chapter 7 or 13 will remedy you of your concerns. As bankruptcy can be complicated, it’s best to consult with an attorney to address what you are hoping to achieve by filing and if there are other options.
Do You Qualify for Bankruptcy? 
Personal bankruptcy, Chapters 7 and 13, have certain eligibility requirements. For instance, if you are going to file for Chapter 7, you’ll have to have a low enough income. For Chapter 13, your debts can’t exceed a certain limit.
Not everyone qualifies for bankruptcy and debtors’ cases can be dismissed if they don’t comply with the courts requirements. For this reason individuals are discouraged from filing without the help of a bankruptcy professional or bankruptcy attorney; there are simply too many laws and policies that can be missed that may result in the dismissal of your case or worse, fraud which results in fines or criminal charges.
Is it Time to File for Bankruptcy? 
If you are looking for the answer of whether or not you should file for bankruptcy, you should start by asking yourself the above questions. If you find that you can’t afford a debt management plan, are unemployed and have no way to pay off any kind of debt, your best bet may be to consult with a bankruptcy attorney.
Ultimately a bankruptcy attorney will be able to help you explore your options and help you get through what is undoubtedly a stressful and challenging time in your life.

Credit unions, payday loans, and internet loans to name a few, often make debtors sign voluntary wage assignments so that they can take money from the consumers’ paycheck in the event they fail to make the installment payments.

It’s true!

Pursuant to the Federal Trade Commission Trade Regulation Rules 16 CFR (I)(D)  444.2.  The FTC Trade Regulation, in relevant part provides that:
In connection with the extension of credit to consumers in or affecting commerce, as commerce is defined in the Federal Trade Commission Act, it is an unfair act or practice within the meaning of Section 5 of that Act for a lender or retail installment seller directly or indirectly to take or receive from a consumer an obligation that:
(3) Constitutes or contains an assignment of wages or other earnings unless:
(i) The assignment by its terms is revocable at the will of the debtor, or
(ii) The assignment is a payroll deduction plan or preauthorized payment plan, commencing at the time of the transaction, in which the consumer authorizes a series of wage deductions as a method of making each payment,  or

(iii) The assignment applies only to wages or other earnings already earned at the time of the assignment. 

Therefore, We can send certain revocations to your payroll and to your creditor to stop the deductions. 

The creditor can then take other steps to collect, but these are thwarted upon filing of the bankruptcy chapter 7 or chapter 13 case.

So far, in 2014 there have been 29,052 bankruptcy cases filed in the Northern District of Illinois

Compared to this time last year, when 31,754 cases were filed, down, almost 9%.
Adversary proceedings were down from 1064 to just 610 this year, over 42%.
11,120 (38%) of these cases were for debtors living in Chicago, followed by 592 in Rockford, 536 in Aurora, 452 living in Joliet, 289 from Plainfield, 281 in Elgin, 280 in Bolingbrook,  271 in Calumet City,  246 in Waukegan, 238 in Naperville, 232 in Dolton,  226 in Berwyn, and 211 in Des Plaines.
The remaining cities were each all below 200 filings.
